Legal Services Terms & Conditions

Introduction

  • TEN Premier Legal Services (“TEN Premier”) is a legal consultancy offering advice and guidance on a range of legal matters. These Terms & Conditions (“Terms”) apply to all services provided by TEN Premier to our Exclusive Partners.
  • By engaging TEN Premier to provide legal services, you (“Exclusive Partner”) agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.
  • TEN Premier reserves the right to amend these Terms at any time without notice. Any changes will be effective from the date they are posted on our website.

Scope of Services

  • TEN Premier offers legal consultancy service. Muklesur Bharuya, a dual-qualified Barrister-at-Law in England and Wales (Bar Member Number 75311) and Attorney-at-Law in France (Bar Number 127 120), will carry out any legal consultancy work for TEN Premier.
  • TEN Premier will not provide legal services in certain “reserved areas” that would require us to be an SRA-regulated firm. These reserved areas include appearing in court, conducting litigation, lodging certain property documents, conducting probate, administering oaths, and notarial activities. As such, TEN Premier does not operate in these areas. Instructions through Chambers or Solicitors are required.
  • TEN Premier does not guarantee the outcome of any legal matter and will not be liable for any losses or damages incurred by the Exclusive Partner.

Confidentiality and Privilege

  • TEN Premier is committed to maintaining the confidentiality of all information provided by the Exclusive Partner. Any information disclosed by the Exclusive Partner will only be used for the purpose of providing legal services and will not be disclosed to any third party without the Exclusive Partner’s consent.
  • When working with traditional law firms, advice provided is considered “privileged”. This means that correspondence between a Exclusive Partner and solicitor can, if made confidentially and for the purposes of legal advice, be withheld from a court or third party in connection with litigation proceedings. As TEN Premier Legal Services operates as a legal consultancy, it means that certain advice we provide may not be “privileged” but rather will be treated in the same manner as advice from your accountants or anyone else who is not a regulated advisor such as a solicitor or barrister. This does not affect our confidentiality obligations to you, and our engagement letter confirms that any advice or discussions we have will be kept confidential.

Fees

  • TEN Premier’s fees will be discussed and agreed with the Exclusive Partner prior to the provision of any legal services.
  • In some cases, TEN Premier may agree to provide legal services on a contingency fee basis, where our fees are only payable if we are successful in recovering damages or other compensation for the Exclusive Partner.
  • TEN Premier reserves the right to recover costs and expenses incurred in providing legal services, including but not limited to travel expenses, court fees, and expert fees.

Insurance and Liability

  • TEN Premier is not required to have professional indemnity insurance that meets the SRA’s minimum terms and conditions (MTCs) set out here. Regardless, TEN Premier has chosen to maintain professional indemnity cover of £1,000,000 per claim so our Exclusive Partners still benefit from insurance protection.
  • TEN Premier’s liability to the Exclusive Partner is limited to the amount of fees paid by the Exclusive Partner for the relevant legal services.

Termination

  • Either party may terminate the engagement at any time by giving written notice.

Jurisdiction and Governing Law

  • These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the courts of England and Wales in relation to any dispute arising out of or in connection with these Terms & Conditions.

Entire Agreement

  • These Terms & Conditions constitute the entire agreement between you and TEN Premier Legal Services and supersede all prior agreements, understandings or arrangements (both oral and written) relating to the subject matter of these Terms & Conditions.

Changes to Terms & Conditions

  • TEN Premier Legal Services may change these Terms & Conditions from time to time by updating this page. You should check this page regularly to ensure that you are happy with any changes to these Terms & Conditions. Your continued use of TEN Premier Legal Services’ website and services after any such changes constitutes your acceptance of the new Terms & Conditions.

Severability

  • If any provision of these Terms & Conditions is held to be invalid or unenforceable for any reason, the remaining provisions shall continue in full force and effect.

Waiver

  • No waiver by TEN Premier Legal Services of any breach of these Terms & Conditions shall be considered as a waiver of any subsequent breach of the same provision or other provision.

Third-Party Rights

  • Nothing in these Terms & Conditions is intended to, nor shall it be construed as, giving any person who is not a party to these Terms & Conditions any rights under the Contracts (Rights of Third Parties) Act 1999.
